It might be an overstatement to say that AIG (NYSE: AIG  ) wants Bank of America's (NYSE: BAC  ) head on a platter, but it's not far-fetched to say that the insurer is ready to get tough with the bank. With one more court ruling going to AIG's win column, a long-standing suit can start moving along, with $7 billion in damages hanging in the balance.

A federal court judge ruled in favor of AIG on Monday when she wrote that the insurer did not give up its rights to pursue certain legal claims after it sold troubled securities to the Federal Reserve�Bank of New York during a 2008 bailout. This ruling clears up a major blockade that had halted any proceedings, with Bank of America claiming that when AIG transferred the securities to the FRBNY, it lost any ability to sue over the investments.

This new ruling came after another in favor of the insurer, which petitioned for the case to be moved to the state court systems -- arguing that the federal court system was not the correct venue for the case. A judge agreed, with a ruling that the case should be heard in the New York State courts.

    LOS ANGELES (MarketWatch) -- Australia stocks rose early Thursday, with miners leading the way higher after a positive production report from Rio Tinto Ltd. (AU:RIO) (RIO) , while overall sentiment got a lift from U.S. gains overnight. The S&P/ASX 200 (AU:XJO) improved by 0.6% to 5,274.30, with shares of Rio Tinto rising 2.2% after reporting record high iron-ore shipments for 2013 and a sold gain for copper output. Rio's peers also advanced, with BHP Billiton Ltd. (AU:BHP) (BHP) up 1.7%, Fortescue Metals Group Ltd. (AU:FMG) (FSUMF) ahead by 3.2%, and Oz Minerals Ltd. (AU:OZL) (OZMLF) adding 2.4%.     LOS ANGELES (MarketWatch) -- Australian stocks advanced Tuesday, as gains in market heavyweight BHP Billiton Ltd. helped push the equity benchmark toward its sixth consecutive win. The S&P/ASX 200 index (AU:XJO) rose 0.2% to 5,364.90 on strength in the mining group after BHP Billiton (AU:BHP) (BHP) raised its fiscal-year forecast for iron-ore production to 212 million metric tons following record output from its mining site in Australia's Pilbara region. BHP shares climbed 1.7%, iron-ore producer Fortescue Metals Group Ltd. (AU:FMG) (FSUMF) rose 0.9% and Rio Tinto Ltd. (AU:RIO) (RIO) picked up 0.4%. Finance issues mostly higher as well, with Westpac Banking Corp. (AU:WBC) (WEBNF) up 0.6%. But underperforming the benchmark were shares of David Jones Ltd. Prosperity Bancshares, Inc., incorporated on December 22, 1983, is a financial holding company. The Company operates through its bank subsidiary, Prosperity Bank (the Bank). The Bank provides a broad line of financial products and services to small and medium-sized businesses and consumers. As of December 31, 2012, the Bank operated 213 full service banking locations; 59 in the Houston area; 20 in the South Texas area including Corpus Christi and Victoria; 35 in the Dallas/Fort Worth area; 21 in the East Texas area; thirty-four 34 in the Central Texas area including Austin and San Antonio; 34 in the West Texas area including Lubbock, Midland-Odessa and Abilene; and 10 in the Bryan/College Station area. Lending Activities

The Company, through the Bank, offers a variety of traditional loan and deposit products to its customers, which consist primarily of consumers and small and medium-sized businesses. The Company offers a variety of commercial lending products including term loans and lines of credit. The Company offers a broad range of short to medium-term commercial loans, primarily collateralized, to businesses for working capital (including inventory and receivables), business expansion (including acquisitions of real estate and improvements) and the purchase of equipment and machinery.

The Company makes commercial real estate loans collateralized by owner-occupied and non-owner-occupied real estate to finance the purchase of real estate. The Company�� commercial real estate loans are collateralized by liens on real estate, typically have variable interest rates (or five year or less fixed rates) and amortize over a 15 to 20 year period. Company�� lending activities al! so includ! es the origination of 1-4 family residential mortgage loans collateralized by owner-occupied residential properties located in the Company�� market areas. The Company offers a variety of mortgage loan products which generally are amortized over five to 25 years. Loans collateralized by 1-4 family residential real estate generally have been originated in amounts of no more than 89% of appraised value or have mortgage insurance. The Company requires mortgage title insurance and hazard insurance. Other than with respect to mortgage banking activities acquired in the ASB acquisition, the Company has elected to keep all 1-4 family residential loans for its own account rather than selling such loans into the secondary market. By doing so, the Company is able to realize a higher yield on these loans; however, the Company also incurs interest rate risk as well as the risks associated with nonpayments on such loans. The Company makes loans to finance the construction of residential and, to a lesser extent, nonresidential properties. Construction loans generally are collateralized by first liens on real estate and have floating interest rates. The Company provides agriculture loans for short-term crop production, including rice, cotton, milo and corn, farm equipment financing and agriculture real estate financing.

Investment Activities

The Company uses its securities portfolio to manage interest rate risk and as a source of income and liquidity for cash requirements. At December 31, 2012, the carrying amount of investment securities totaled $7.44 billion. At December 31, 2012, securities represented 51.0% of total assets. At December 31, 2012 and 2011, the Company did not own securities of any one issuer (other than the U.S. government and its agencies) for which aggregate adjusted cost exceeded 10% of the consolidated shareholders equity .

Sources of Funds

The Company offers a variety of deposit accounts having a wide range of interest rates an! d terms i! ncluding demand, savings, money market and time accounts. The Company relies primarily on competitive pricing policies and customer service to attract and retain these deposits. The Company does not have or accept any brokered deposits. Total deposits at December 31, 2012, were $11.64 billion. Noninterest-bearing deposits at December 31, 2012, were $3.02 billion. The Company utilizes borrowings to supplement deposits to fund its lending and investment activities. Borrowings consist of funds from the Federal Home Loan Bank (FHLB) and securities sold under repurchase agreements.

    Wyomissing, Pa.-based Customers Bancorp (NASDAQ: CUBI  ) has a new CFO.

    On Tuesday, Customers Bancorp announced that Interim Chief Financial Officer James D. Hogan�intends to retire from the bank on Aug. 13. Replacing Hogan will be Robert E. Wahlman, a new hire from Doral Financial, who will join Customers initially in the post of executive vice president on Aug. 5, and then be promoted to permanent CFO on the 13th.

    The ETFs and funds held up on Monday:

    JPMorgan Alerian MLP Index ETN (NYSEArca: AMJ) was down only 0.3% at $46.86, versus a 52-week range of $42.18 to $49.31. Volume was 1.1 million shares versus an average of about 628,000. ALPS Alerian MLP ETF (NYSEArca: AMLP) closed down 0.45 at $17.57, versus a 52-week range of $16.75 to $18.36. This ETF traded more than 3.1 million shares, up from an average of about 2.85 million shares. The closed-end fund of Kayne Anderson MLP Investment Company (NYSE: KYN) even managed to rise by 0.26% to $38.70 against a 52-week range of $33.11 to $40.22. Its volume was also almost 300,000 shares versus an average volume of closer to 218,000 shares.

    It still seems more than interesting that the investment community did not pound the rest of the sector in sympathy with Boardwalk. This Boardwalk MLP still has a $3.1 billion market cap, even after getting cut almost in half. Usually investors try to tie in peers when one implosion is seen versus others. It seems as though they are trusting that negative natural gas exposure here is not going to spill over into the rest of the sector, and maybe not even spill over into the price of units in its more direct peers.

Bank of the Ozarks, Inc. is a bank holding company. The Company owns an Arkansas state chartered subsidiary bank, Bank of the Ozarks (the Bank). At December 31, 2011, the Company, through the Bank, conducted banking operations through 111 offices, including 66 offices in Arkansas, 27 in Georgia, 10 in Texas, four in Florida, two in North Carolina, and one each in South Carolina and Alabama. Subsequent to December 31, 2011, the Company opened its 11th and 12th Texas offices in Austin and The Colony. Lending and Leasing Activities

The Company�� primary source of income is interest earned from its loan and lease portfolio and its investment securities portfolio. The Company�� portfolio of real estate loans includes loans secured by residential one- to four-family, non-farm/non-residential, agricultural, construction/land development, multifamily residential (five or more family) properties and other land loans. Non-farm/non-residential loans include those secured by real estate mortgages on owner-occupied commercial buildings of various types, leased commercial, retail and office buildings, hospitals, nursing and other medical facilities, hotels and motels, and other business and industrial properties. Agricultural real estate loans include loans secured by farmland and related improvements, including some loans guaranteed by the Farm Service Agency. Real estate construction/land development loans include loa! ns secure! d by vacant land, loans to finance land development or construction of industrial, commercial, residential or farm buildings or additions or alterations to existing structures. Included in the Company�� residential one- to four-family loans are home equity lines of credit.

The Company offers a variety of real estate loan products that are generally amortized over five to thirty years. The Company originates residential mortgage loans to be resold on the secondary market primarily through its banking offices located in Arkansas��markets, many of its Texas banking offices and in certain of its acquired offices in the Southeastern United States. The Company offers a range of trust and wealth management services from its headquarters in Little Rock, Arkansas, with additional staff in Rogers, Arkansas. These trust and wealth management services include personal trusts, custodial accounts, investment management accounts, retirement accounts, corporate trust services, including trustee, paying agent and registered transfer agent services, and other incidental services. As of December 31, 2011, total trust assets were approximately $1.02 billion.

The Company offers treasury management products which are designed to provide specialized support to the treasury operations of business and public funds customers.     Bank of the Ozarks (NASDAQ: OZRK  ) is rewarding its shareholders by paying a higher dividend. The company has declared a common stock dividend of $0.19 per share, to be handed out on July 19 to shareholders of record as of July 12. That amount is $0.02, or 12%, higher than the company's previous disbursement of $0.17 per share, which was paid in mid-April.
